MAROHA is a hybrid eCommerce marketplace. We offer maternity and nursing products sold by:

  • Third-party vendors (independent sellers) who manage their own listings, pricing, and shipping.
  • Our platform, selling directly as a retailer for selected brands or products.

2. Eligibility

To use this Platform, you must be at least 18 years old or have the consent of a legal guardian. By using the Platform, you represent that you meet these requirements.

MAROHA reserves the right to deny or terminate user access at any time without prior notice, particularly for violation of these Terms.


3. Account Registration

You may be required to create an account to place orders, track shipments, or become a vendor. You are solely responsible for maintaining the confidentiality of your account information and for all activities conducted under your account.


4. Product Listings and Descriptions

We strive to ensure product listings are accurate. However:

  • Third-party vendors are solely responsible for the accuracy, legality, and availability of their listings.
  • We reserve the right to correct errors or inaccuracies at any time without prior notice.

5. Order Processing and Fulfillment

  • Vendor Products: When you purchase from a third-party vendor, that vendor is solely responsible for order fulfillment and shipping. Disputes or refund requests must be directed to the vendor.
  • Platform Products: When you purchase from our inventory, MAROHA is responsible for fulfillment and customer service.

We may assist in mediation in the event of a dispute but are not liable for third-party vendor obligations.


6. Pricing and Payments

  • All prices are listed in INR (₹) unless otherwise specified.
  • Prices are subject to change without prior notice.
  • Payments are processed via secure third-party payment gateways.
  • In case of cancellation/refund, timing and method depend on whether the order was fulfilled by us or by a third-party vendor.

7. Returns and Refunds

  • Each vendor has their own return and refund policy, displayed on their product pages.
  • For platform-sold products, returns are subject to our Return Policy.
  • Customers are responsible for reviewing return policies before placing an order.

8. Vendor Obligations

As a Vendor on MAROHA, you agree to the following:

  1. Accurate Product Information
    Provide complete, truthful, and up-to-date product details, including descriptions, images, pricing, and stock availability.
  2. Compliance with Laws
    Ensure all products comply with applicable Indian laws and regulations, including safety, labeling, and consumer protection standards.
  3. Timely Order Fulfillment
    Process and ship orders promptly within the specified timeframe to ensure customer satisfaction.
  4. Customer Service
    Respond professionally and promptly to customer inquiries, complaints, and return requests.
  5. Returns and Refunds
    Honor your published return and refund policies in accordance with applicable laws and the Platform’s guidelines.
  6. Prohibited Items
    Do not list or sell prohibited, counterfeit, illegal, or unsafe products as defined by the Platform and applicable law.
  7. Inventory Management
    Keep inventory levels accurate to avoid overselling and notify the Platform immediately of any stock issues.
  8. Intellectual Property Compliance
    Respect third-party intellectual property rights and ensure all product content is lawful and authorized.
  9. Accurate Tax Compliance
    Comply with all applicable tax laws, including GST registration, invoicing, and remittance obligations.
  10. Platform Policies
    Abide by all Marketplace rules, policies, and procedures, including any updates communicated by the Platform.

Failure to comply may result in account suspension or termination.


9. Intellectual Property

9.1 Platform Ownership

All content on the Platform — including but not limited to text, graphics, logos, images, product layouts, user interface elements, audio clips, digital downloads, data compilations, and software — is the property of MAROHA or its licensors and is protected under applicable Indian intellectual property laws, including the Copyright Act, 1957 and Trademarks Act, 1999.

You may not reproduce, modify, distribute, transmit, display, perform, or use any part of the Platform’s content without our prior written permission.

9.2 Vendor Content

Vendors retain ownership of the images, logos, trademarks, product descriptions, and other content they upload to their stores. However, by uploading such content to the Platform, the Vendor grants MAROHA a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content for the purpose of operating, promoting, and improving the Platform.

Vendors represent and warrant that:

  • They have all necessary rights and permissions to use and license the content.
  • Their content does not infringe on any third-party intellectual property rights.

9.3 Infringement Claims

If you believe that any content on the Platform violates your intellectual property rights, please contact us immediately at [connect.maroha@gmail.com] with the relevant details. We will promptly investigate and take appropriate action under applicable law, including the Information Technology Act, 2000.


10. Prohibited Conduct

You agree not to engage in any of the following activities while using the Platform, whether as a buyer, vendor, or visitor:

  1. Illegal Activity
    Engaging in or promoting any activity that violates applicable laws, rules, or regulations (local, national, or international).
  2. Infringement
    Posting, listing, or selling counterfeit, pirated, or unauthorized products; or violating intellectual property rights of others.
  3. Fraud or Misrepresentation
    Providing false information, impersonating others, misrepresenting products or services, or manipulating transactions (e.g., fake reviews, false claims).
  4. Harassment or Abuse
    Threatening, harassing, defaming, or abusing other users, vendors, or our team.
  5. Spam and Unsolicited Communication
    Sending unsolicited messages, advertisements, or promotional content not permitted by the Platform.
  6. Security Violations
    Attempting to access data or systems without authorization, introducing malware, or interfering with the Platform’s security or performance.
  7. Disruption of Service
    Overloading or disrupting the Platform infrastructure, scraping data, or using bots without our permission.
  8. Circumvention of Platform Policies
    Attempting to bypass payment processes, commissions, or any other Platform mechanisms designed for fairness and transparency.
  9. Unacceptable Product Listings
    Listing prohibited items such as unsafe products, offensive content, or restricted goods (e.g., medicines, weapons, adult content).
  10. Non-Compliance with Return/Shipping Standards
    Deliberately delaying shipments, refusing valid returns, or failing to meet your obligations as a seller.

11. Limitation of Liability

  • To the maximum extent permitted by applicable law, [MAROHA] (including its directors, officers, employees, affiliates, agents, and licensors) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with:

  • Any products sold or purchased through the Platform;
  • Any conduct or content of any third party on the Platform, including vendors;
  • Any unauthorized access, use, or alteration of your information.

In any case, our total liability to you for all claims relating to the use of the Platform shall not exceed the total amount paid by you to us in the six (6) months preceding the claim. Nothing in these Terms limits or excludes liability for gross negligence, fraud, or willful misconduct.


12. Indemnification

You agree to indemnify, defend, and hold harmless [MAROHA], its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or related to:

  • Any transaction or dispute between you and another user (including vendors or customers).

We reserve the right to modify, update, or replace any part of these Terms and Conditions at any time, at our sole discretion. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.


14. Governing Law

These Terms and Conditions are governed by the laws of India, without regard to its conflict of laws principles.
